About these terms

These Terms of Service govern your use of the Buzzberry Farms online store and your purchase of products from it. By using this store or placing an order, you agree to these terms. If you do not agree, please do not use the store.

Our production and packing facility is located separately at 655 Hawthorne Ave, Athens, GA 30606. The facility address identifies the manufacturing and packing location and does not replace the legal/business address above.

Our products

We sell honey and honey-based food products. Product descriptions, images, and packaging are provided in good faith. Honey is a natural product, and color, flavor, aroma, texture, and crystallization vary naturally between harvests.

Product availability

Products are offered subject to availability. We may change or discontinue products, and we may limit quantities, without notice.

Orders, pricing and payment

All prices are shown in US dollars and do not include shipping or applicable taxes. Shipping charges and any applicable tax are calculated and shown separately at checkout before you pay.

Placing an order is an offer to buy. We may decline or cancel an order — for example where a product is unavailable, where there is an error in pricing or product information, or where we suspect fraud. If we cancel an order you have already paid for, we will refund it in full.

We make reasonable efforts to keep pricing and product information accurate. If an error affects your order, we will contact you before shipping and give you the choice to proceed at the corrected price or cancel for a full refund.

Shipping and risk of loss

Shipping is governed by our Shipping Policy. Risk of loss passes to you when the carrier delivers the order to the shipping address you provided at checkout.

Returns and refunds

Returns and refunds are governed by our Refund Policy, which forms part of these terms. Honey and other edible products are final sale. Where these terms and the Refund Policy differ on returns, the Refund Policy applies.

Food safety and natural variation

Our honey may contain naturally occurring pollen and other bee-derived traces. Do not feed honey to infants under 12 months of age. Crystallization and natural variation in appearance and flavor are normal characteristics of honey and are not defects.

Your account

If you create an account, you are responsible for the accuracy of your information and for activity that takes place under your account. Please keep your login details secure and tell us promptly if you believe your account has been used without your permission.

Acceptable use

You agree not to use this store for any unlawful purpose, not to interfere with its operation or security, and not to attempt unauthorized access to any part of it or to other users' data.

You agree not to use automated means to place orders without authorization, circumvent access controls, interfere with the operation or security of the store, or impose an unreasonable burden on the store or its systems.

Intellectual property

The Buzzberry Farms name, logo, product names, photography, and site content are our property or used with permission, and are protected by applicable intellectual property law. You may not use them without our written permission.

Content you submit

If you send us reviews, photographs, or other content, you grant us a non-exclusive, royalty-free licence to use it in connection with our business, and you confirm that you have the right to give that permission.

Third-party services

This store is hosted by Shopify, and checkout and payment processing are handled through Shopify and its payment providers. Their handling of your information is described in our Privacy Policy.

Disclaimer and limitation of liability

This store and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence. To the fullest extent permitted by law, our total liability in connection with an order is limited to the amount you paid for that order.

We may update these terms from time to time. The version published on this page at the time you place an order applies to that order.

Governing law

These Terms and your use of the Site are governed by the laws of the State of Georgia, USA, without regard to its conflict of law principles.

Any disputes arising under or in connection with these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Georgia, USA, and you consent to the personal jurisdiction of such courts.
